Terms of service

Article 1 — Seller identification

The online store available at https://www.store.laboratoire-vitalsante.com is published and operated by:

Laboratoire Vital Santé

209 Boulevard Sylvain Dupuis 1070 Anderlecht – Brussels Belgium

Company registration and VAT number: BE 0758.657.784

Email: contact@laboratoire-vitalsante.com

Hereinafter referred to as “Laboratoire Vital Santé” or the “Seller”.

Article 2 — Purpose and scope

These General Terms and Conditions of Sale and Use define the rights and obligations of Laboratoire Vital Santé and its customers in connection with purchases made through its online store.

They apply to orders placed by consumers acting for personal purposes outside any professional activity.

Sales to pharmacies, resellers and other professionals may be subject to specific commercial terms.

By placing an order, customers acknowledge and accept these terms in accordance with the procedures set out during checkout.

The terms applicable are those in force when the order is placed, subject to mandatory legal provisions.

These General Terms and Conditions should be read together with our shipping policy, refund policy and privacy policy.

Article 3 — Product presentation and characteristics

Laboratoire Vital Santé sells food supplements, particularly under the Cartilamine, Veinavital and Cognito brands.

Each product page sets out the essential characteristics of the item offered for sale, including its name, composition, dosages, packaging, directions for use and precautions.

Photographs and other visuals are intended to present products faithfully. If packaging changes, the information provided at the time of ordering must enable customers to identify clearly the product actually offered.

Food supplements are not medicines and do not replace a varied, balanced diet, a healthy lifestyle or medical treatment.

Consumers are advised to follow the directions and precautions shown on the product label.

Article 4 — Changes to formulations and checks before ordering

Laboratoire Vital Santé may update its formulations, packaging or product presentation as its ranges develop and to comply with applicable requirements.

These changes are described on the relevant product pages.

We ask customers to carefully check the composition, dosages, characteristics and visuals of the product currently offered for sale before confirming an order, particularly if they are familiar with an earlier version.

An order relates to the product described at the time of purchase, not automatically to a formulation previously marketed.

Where the delivered product matches the characteristics clearly stated and the order placed, failure to read that information does not, by itself, constitute a lack of conformity.

No substantial modification of a product after the conclusion of a contract may be imposed on consumers contrary to their statutory rights.

This provision does not limit the statutory right of withdrawal, where applicable, or statutory guarantees.

Article 5 — Availability and pre-orders

Products are offered subject to stock availability.

Laboratoire Vital Santé endeavours to keep information about availability up to date.

Where a product is offered for pre-order, this status and the relevant availability and delivery information are clearly stated before purchase.

If an item becomes unavailable after an order is confirmed, the customer will be informed as soon as possible.

An appropriate solution will then be proposed, such as waiting for restocking with the customer's agreement or cancelling the order and refunding the sums due.

Article 6 — Prices

Product prices are displayed in the currency of the selected market, inclusive of applicable taxes where required by law.

Any delivery charges are specified before the order is finally confirmed.

Laboratoire Vital Santé reserves the right to change its prices and commercial offers at any time, without retroactively affecting an order already concluded.

The price charged is the price applicable at the time of ordering, subject to the legal rules governing manifest errors.

Promotional codes and commercial benefits may be used subject to the conditions and validity periods stated when they are offered.

For deliveries outside the European Union, any customs duties, import taxes and additional charges are handled and communicated in accordance with applicable law and the information provided before purchase.

Article 7 — Orders

To place an order, customers select the desired products, review their basket and provide the information needed for billing and delivery.

Before final confirmation, they can check product characteristics and quantities, prices and any charges, and correct entry errors.

Final order confirmation entails an obligation to pay, which is clearly indicated during checkout.

An order confirmation is then sent electronically, together with the required contractual information.

Laboratoire Vital Santé may refuse or cancel an order for a legitimate and objectively justified reason, particularly where there is serious evidence of fraud, an inability to deliver or a product is unavailable.

Where payment has already been collected and the order cannot be fulfilled, the corresponding amounts are refunded in accordance with the law.

Confirming an order does not deprive consumers of their statutory right of withdrawal.

Article 8 — Information provided by customers

Customers must provide accurate, complete and up-to-date information, particularly concerning their identity, delivery address and contact details.

If an error is noticed after ordering, customers are asked to contact our customer service team promptly.

Laboratoire Vital Santé will do its best to accommodate a correction request before dispatch, subject to logistical constraints.

Where an error attributable to the customer results in justified additional reshipping costs, those costs may be charged to the customer in accordance with our shipping policy.

Article 9 — Payment

Orders are paid for using the payment methods offered on our store at checkout.

Available payment methods are indicated during the ordering process.

Transactions are processed by specialist payment service providers using appropriate security measures.

Where payments are processed by these providers, Laboratoire Vital Santé does not directly collect customers' full payment card details.

If a payment is declined or a transaction is unauthorised, the order cannot be fulfilled under the intended terms.

Article 10 — Order preparation and delivery

Orders are prepared and dispatched by our logistics partner Inelogis, based in Rouffiac-Tolosan, France.

Deliveries are mainly handled by Colissimo or other carriers offered at the time of purchase.

Served destinations, available delivery methods, charges and delivery-time information are provided during checkout.

Laboratoire Vital Santé remains responsible for fulfilling its delivery obligations as required by law.

Where the carrier is offered by the Seller, the risk of loss or damage is, in principle, borne by the Seller until the consumer or a third party designated by the consumer, other than the carrier, takes physical possession of the parcel.

In the event of a delay, loss, damaged parcel or delivery issue, customers are invited to contact customer service so that the situation can be investigated.

Detailed conditions are set out in our shipping and delivery policy. Read more

Article 11 — Right of withdrawal and returns

Consumers have the withdrawal rights provided under applicable law.

For relevant distance-selling contracts, this right can generally be exercised within 14 calendar days following receipt of the products, without having to give a reason.

However, legal exceptions may apply, particularly to certain sealed goods that are unsuitable for return for health protection or hygiene reasons once unsealed after delivery.

Whether this exception applies depends on the product's characteristics and the legal requirements.

Consumers may notify their decision to withdraw by sending a clear statement to:

contact@laboratoire-vitalsante.com

Exercising the statutory right of withdrawal does not require prior authorisation from Laboratoire Vital Santé.

Detailed return arrangements, applicable costs, time limits and refund conditions are set out in our refund and return policy. Read more

Any specific rights available to consumers in other countries to which we deliver remain unaffected.

Article 12 — Statutory guarantees and conformity

Products sold are covered by the statutory guarantees applicable to consumers.

These guarantees include situations where a delivered product does not match the characteristics agreed in the contract or has a lack of conformity.

For consumers subject to Belgian law, the statutory guarantee of conformity for consumer goods applies under the conditions laid down by law, including its two-year regime.

Mandatory rights applicable to consumers in other countries remain unaffected.

The specific characteristics of food products, including their storage conditions and best-before dates, must be taken into account when assessing conformity.

Customers may contact our customer service team to report a problem and obtain the remedies provided by law.

Nothing in these General Terms and Conditions limits statutory guarantees or any liability of the Seller that cannot legally be excluded.

Article 13 — Use and storage of products

Food supplements must be used in accordance with the directions and precautions on their labels.

Consumers are responsible for following the storage conditions, recommended daily amounts and any contraindications.

If in doubt about a personal situation, medication or medical condition, seek advice from a doctor or pharmacist.

Inappropriate use or storage contrary to the instructions provided may be taken into account when reviewing a complaint, but does not automatically remove consumers' statutory rights.

Article 14 — Liability

Laboratoire Vital Santé undertakes to fulfil the legal and contractual obligations applicable to the sale of its products.

It cannot be held liable for consequences attributable exclusively to clearly improper use contrary to the instructions provided, subject to any liability it has under the law.

Nothing in these General Terms and Conditions is intended to exclude or limit liability where doing so is prohibited under applicable law, particularly with regard to conformity, product safety and consumer protection.

Article 15 — Exceptional events and force majeure

Where an event meeting the legal requirements for force majeure prevents performance of an obligation, the consequences will be determined under applicable law.

A logistical difficulty, supply shortage or transport incident does not automatically constitute force majeure.

Laboratoire Vital Santé informs affected customers when necessary and applies the rights and remedies provided by law.

Article 16 — Intellectual property

Texts, photographs, illustrations, logos, trademarks, graphics and other content on the store are protected by applicable intellectual property rights.

Any unauthorised reproduction, adaptation, distribution or exploitation of these materials is prohibited, subject to legal exceptions.

Brands and trade names appearing on the store remain the property of their respective owners.

Article 17 — Personal data

Personal data collected in connection with browsing, orders, customer service and communications is processed in accordance with applicable legislation, particularly the General Data Protection Regulation (GDPR).

Information about processing purposes, recipients, retention periods and individuals' rights can be found in our privacy policy. Read more

Article 18 — Complaints and mediation

For any question or complaint relating to an order, customers can contact:

Laboratoire Vital Santé

Email: contact@laboratoire-vitalsante.com

We prioritise finding an amicable solution appropriate to each situation.

If a dispute cannot be resolved directly, consumers may seek information about the applicable out-of-court dispute resolution schemes.

For a business established in Belgium, the Consumer Mediation Service may, within the scope of its powers, provide information to consumers and handle or refer their requests.

Consumer Mediation Service Boulevard du Roi Albert II 8, box 1 1000 Brussels – Belgium

Email: contact@mediationconsommateur.be

Website: https://www.mediationconsommateur.be

This process does not deprive consumers of the right to bring proceedings before a competent court.

Article 19 — Applicable law and disputes

These General Terms and Conditions of Sale are governed by Belgian law.

However, this choice does not deprive consumers of the mandatory protective provisions of the law of their country of habitual residence where applicable.

In the event of a dispute, the competent courts are determined in accordance with applicable legal rules, particularly those governing consumer contracts.

Nothing in these terms imposes an exclusive judicial jurisdiction on consumers contrary to their rights.

Article 20 — Changes to the General Terms and Conditions

Laboratoire Vital Santé may amend these terms to reflect changes in its business, services or the law.

The new terms apply to orders concluded after they take effect.

Subsequent changes cannot undermine rights acquired under orders concluded previously.

The applicable version is the one made available when the order is placed.
